Terms & Conditions for Veterinary Professionals – Business Accounts

1. Definitions

The concepts used in these Terms and Conditions (“Terms”) shall be understood according to the following definitions:

Veterinary Professional Account - A set of Website resources and privileges supplied to a Veterinary Professional by the Operator or Clinic in the form of a business account following registration by the Veterinary Professional.
Veterinary Professional - A person who is qualified and contracted to provide veterinary services such as a veterinarian, veterinary nurse, or animal health professional. The Veterinary Professional will use the Website to provide Users and/or Pet Owners with services via a Veterinary Professional Account under the terms of cooperation with the Operator.
We, Operator, or OnLive - OnLive Ltd, a company registered as the operator of PetsCare.com.
Website - The PetsCare.com website owned and operated by OnLive Ltd, which the User may use to place an Order for services using a User Account according to these Terms.
Clinic - A veterinary entity where Veterinary Professionals are based, such as an animal hospital or veterinary clinic, which under the terms of cooperation with the Operator has gained access to a system account used for the management of the work and accounts of Veterinary Professionals.
User - Any natural person with full legal capacity (having attained 18 years of age) who has entered or intends to enter into an agreement for the use of the Services via the Website.
Pet Owner - A natural person indicated at the time of Order placement by the User for whom the veterinary Services are to be provided.
Order - A declaration of intent by the User via a User Account, constituting an offer to electronically contract with OnLive to provide veterinary services under these Terms.
Contract - A completed Order as a specified agreement under these Terms.
User Account - A digital account service for an individual User on the Website, protected by login and password, based on registration and acceptance of these Terms.
Services - The Service or Services available and/or provided to the Pet Owner via a User Account on the Website, including veterinary health consultations, diagnostic tests, and tailored pet care products.
Referral - The services provided on the Website to enable a Pet Owner to receive a referral from a Veterinary Professional for tests that can be paid for in their User Account.
Survey - A veterinary health survey or questionnaire on the Website to profile and collect basic information about the pet’s health and/or condition, which is then forwarded to a Veterinary Professional with or without data anonymisation (at the pet owner’s option).

2. About These Terms and General Provisions

These Terms along with our Privacy Policy set out:

The scope of Services and the terms on which such Services are provided by the Operator via the Website.
The manner in which Veterinary Professionals can use the Services and the Website.
The Veterinary Professional’s scope of responsibility arising from any actions taken via the Website.
The Terms for the provision of the Services, including any technical conditions of cooperation via the Website.
The procedure for entry into and termination of service agreements between the Veterinary Professional and the Operator regarding the services provided via the Website.
The complaints procedure.

These Terms shall be available free of charge on the Website in a form that is capable of being downloaded, recorded, saved, and printed.

3. Our Services

In order to make full and correct use of the Services provided on the Website, the Veterinary Professional must register a Veterinary Professional Account.

The Veterinary Professional can use the Website to issue Pet Owners with referrals for veterinary tests by selecting the appropriate “Issue a referral” tab and then choosing the set of relevant tests for which the Veterinary Professional intends to issue a referral.

The Veterinary Professional can use the Website to access their referral history, manage appointments, and provide veterinary health descriptions for diagnostic purposes.

Among the available Services, Pet Owners have the option of taking advantage of telephone, video, or teleconference appointments with the Veterinary Professional (remote appointments).

4. Veterinary Professional Account

Registration and use of the Services provided on the Website shall be voluntary.
A Veterinary Professional may have only one Veterinary Professional Account.
The Operator may verify the number of Veterinary Professional Accounts and subject to adequate action undertaken to clarify the incident shall have the right to delete a Veterinary Professional Account where it has become aware that a single Veterinary Professional has more than one account.
The data provided at the time of Registration must be accurate and correct, both legally and factually.

5. Clinic Account

A Veterinary Professional using the Website can cooperate with the clinic that employs them and manages their work in the system.

The clinic coordinator is responsible for:

Adding and activating the accounts of Veterinary Professionals who cooperate with the clinic.
Veterinary Professional availability inquiries.
Managing work schedules of Veterinary Professionals cooperating with the clinic.

6. Warranty and Complaints

The Operator shall provide the Veterinary Professional with the Services with due diligence required for the activities covered under the Agreement.
In the event of a defect in the Services, the Veterinary Professional shall have the right to file a complaint under these Terms and Conditions.

- Via the complaints form on the Website.

7. Termination of Agreement, Cancellation of Service

The Veterinary Professional may close or delete their account from the Website by submitting an e-mail request for account deletion.
A request for account deletion shall be processed within 30 days.

8. Our Liability

The Veterinary Professional and Clinic shall be fully responsible for any actions they take regarding the Website.
The Operator shall not be liable for any false or incorrect data provided by the Veterinary Professional.
The Operator shall not be liable for any malfunctions of the Website beyond its reasonable control.

9. Events Outside Our Control

The Operator will not be liable for any failure to perform, or delay in performance of, any of our Services due to any act or event beyond our reasonable control.
If an event outside our control takes place that affects the performance of our contractual obligations:
- We will contact you as soon as reasonably possible to notify you.
- Our contractual obligations will be suspended for the duration of the event.

10. Amendments to These Terms

The Operator reserves the right to amend these Terms.
Any changes will be communicated via the Website.
